A multi-million dollar birth injury lawsuit has been filed as the result of numerous complications that occurred during the labor and delivery of a Texas boy. According to reports, the child suffered a severe brain injury and now suffers from neurological, cognitive and developmental delays. The medical malpractice complaint alleges that the mother was induced at 36 weeks pregnant, after she came to the hospital suffering pelvic pressure and secretions. During the delivery process, the child's shoulder became lodged in the mother's birth canal – indicating possible should dystocia. The baby showed signs of distress, and physicians used vacuum extraction to assist with the delivery.
The child suffered perinatal asphyxia, and was blue when he was delivered. The child failed to respond to stimuli and was transferred to the Intensive Care Unit for observation and care. When the child was born, he was blue, flaccid and failed to respond to any stimuli.
