The family of a child born with a brain injury has just secured a record setting birth injury verdict. According to reports, a just has awarded a 12-year-old boy and his mother $53 million in a medical malpractice lawsuit. The birth injury lawsuit was filed a little over 3 years ago asserting that the doctors and nurses in change of her care did not provide proper treatment during her pregnancy and the child's birth. As a result of the negligent medical care, the boy now requires help feed, bathe and go to the bathroom.
The family alleged that the health care professionals failed to perform a timely Cesarean section after the baby starting showing signs of fetal distress. During difficult deliveries, when babies are experiencing difficulties, taking quick action to perform an emergency C-Section can reduce or eliminate the severity of a brain injury. However, here the health care professionals delayed in taking precautionary measures, the family asserted.
The hospital disagreed, arguing that the child's cerebral palsy was a result of an infection.
