Fathers' employer may be held liable for children born with birth defects

A recent lawsuit examines the exposure of men to toxic chemicals at the workplace and whether the family’s may maintain personal injury lawsuits on behalf of their children who were born with severe birth defects as a result. In this instance, Motorola is accused of “willful and wanton misconduct” in allowing the exposure. One of the fathers in the lawsuit worked at a semi-conductor plant in Texas, and the other in Arizona. The asserted that they were exposed to toxic chemicals on the job, and that these chemicals led to their children being born with birth defect - one was born with a club foot and the other with an underdeveloped jaw. The court determined that just as claims for negligence are viable for women who are exposed to toxic chemicals on the job and subsequently have children with birth injuries, “it stands to reason it could foresee that a male employee’s impaired sperm could produce the same result.”
