A jury has awarded $23.6M to the family of a girl who sustained serious brain damage due to a delayed Cesarean Section (C-Section). In this instance, the mother presented to the hospital at 36-weeks with complaints of abdominal pain. Despite signs that the infant was in distress, doctors delayed performing an emergency C-Section. The child was delivered three-hours later, after being deprived of oxygen and suffering a serious brain injury. Despite remedial measures being available – such as brain cooling – these steps were not taken.
The child suffered permanent brain damage which will affect her for her life time. The award includes damages for loss of a normal life, pain and suffering and future medical expenses.
